Terms of Service

These Terms of Service (“Terms”) govern your use of the AAKIJA platform (“the Platform”), operated by AAKIJA Ltd (“AAKIJA”, “we”, “us”, “our”), a company registered in England and Wales.

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

  • “Salon” means the business entity that subscribes to the Platform
  • “Owner” means the individual who registers the Salon account and holds full administrative access
  • “Authorised User” means any individual granted access to the Platform by the Owner, including managers and staff
  • “Client” means a customer of the Salon whose data is processed through the Platform
  • “Ki” means the AI intelligence layer within the Platform that analyses data and generates recommendations
  • “Financial Hub” means the finance module within the Platform

2. Eligibility

To use the Platform, you must be at least 18 years old and have the legal authority to bind the Salon to these Terms. By registering, you represent and warrant that you have this authority.

3. Account Registration

  • You must provide accurate, complete, and current information when creating an account
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must notify us immediately of any unauthorised use of your account
  • One Salon subscription corresponds to one business location. Multi-location salons require separate subscriptions (or a group plan when available)
  • You are responsible for all activity that occurs under your account and the accounts of your Authorised Users

4. Subscription Plans and Pricing

4.1 Plans

The Platform is offered on a monthly subscription basis across multiple tiers. Current pricing is displayed on our pricing page. Each plan includes a specified number of staff seats and monthly SMS credits.

4.2 Trial Period

New Salons receive a 30-day trial period. During the trial, a platform transaction fee of 2% applies to payments processed through the Platform. Upon subscribing to a paid plan, this reduces to 1%.

4.3 Billing

  • Subscriptions are billed monthly in advance via Stripe
  • All prices are displayed exclusive of VAT where applicable
  • Failed payments will be retried automatically. If payment fails after multiple attempts, the account may be suspended
  • We reserve the right to change pricing with 30 days’ written notice. Existing subscribers will be given the option to cancel before new pricing takes effect

4.4 Platform Transaction Fee

AAKIJA charges a platform fee on payments processed through the Platform via Stripe Connect. The fee is 2% during the trial period and 1% on paid plans. This fee is deducted automatically at the point of charge. Funds are never held in AAKIJA’s account; Stripe splits payments automatically.

5. Cancellation and Refunds

  • You may cancel your subscription at any time through the Platform or by contacting us
  • Cancellation takes effect at the end of the current billing period. No pro-rata refunds are issued for partial months
  • Upon cancellation, you have 90 days to export your data before it is permanently deleted
  • We may cancel or suspend your account if you breach these Terms, with written notice where practicable

6. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
  • Send unsolicited marketing messages to clients who have not opted in
  • Attempt to access data belonging to another salon or tenant
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use the Platform to store or transmit malicious code, viruses, or harmful content
  • Share login credentials with unauthorised individuals
  • Use automated tools to scrape, crawl, or extract data from the Platform beyond the provided API and export functions
  • Resell, sublicence, or redistribute access to the Platform without our written consent

7. AI Features and Governance

7.1 Ki Intelligence Layer

The Platform includes AI-powered features that analyse your salon data and generate recommendations. These features are provided as decision-support tools and are not a substitute for professional judgement.

7.2 Human-in-the-Loop

All significant AI-generated actions require explicit human approval before execution. Ki proposes actions; it never imposes them. You maintain full control over whether any AI recommendation is executed.

7.3 Audit Trail

Every AI action (proposed, approved, dismissed, executed) is logged to an immutable audit trail. This log cannot be edited or deleted and is accessible to the Salon Owner through the Platform.

7.4 AI Cost Transparency

AI usage costs are tracked per Salon and visible in the settings panel. Each plan includes an AI usage allowance. If the allowance is reached, AI features will be paused until the next billing cycle or until the Salon upgrades their plan.

7.5 No Guarantees on AI Output

While we strive for accuracy, AI-generated insights, recommendations, and drafted content may contain errors or inaccuracies. You are responsible for reviewing all AI outputs before acting on them. AAKIJA is not liable for business decisions made based on AI recommendations.

8. Payments and Stripe Connect

  • Payment processing is provided by Stripe. By using payment features, you also agree to Stripe’s Connected Account Agreement
  • Salons must complete Stripe’s KYC (Know Your Customer) verification to receive payouts
  • AAKIJA does not hold client funds. All payment splits happen at the point of charge through Stripe
  • Refunds processed through the Platform are subject to Stripe’s refund policies and processing times

9. Communications (SMS and Email)

  • The Platform enables Salons to send SMS and email communications to their clients
  • The Salon is responsible for ensuring all marketing communications comply with the Privacy and Electronic Communications Regulations 2003 (PECR) and UK GDPR, including obtaining valid consent
  • Transactional messages (booking confirmations, reminders) are sent as part of the service contract between the Salon and its clients
  • SMS credits are included per plan tier. Additional credits can be purchased as add-ons
  • AAKIJA reserves the right to suspend messaging capabilities if a Salon is found to be sending spam or unsolicited messages

10. Data and Privacy

Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms.

  • The Salon is the Data Controller for client data processed through the Platform. AAKIJA acts as the Data Processor
  • AAKIJA will process data only in accordance with the Salon’s instructions and applicable data protection law
  • A Data Processing Agreement (DPA) is available on request and is incorporated into these Terms by reference
  • All data is isolated per Salon at the database level. No Salon can access another Salon’s data

11. Intellectual Property

  • The Platform, its design, code, AI models, features, and all associated intellectual property are owned by AAKIJA Ltd
  • Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose during your subscription term
  • You retain ownership of all data you input into the Platform. We claim no ownership of your salon data, client records, or business information
  • Content generated by Ki (insights, drafted messages, campaign copy) is provided as a tool output for your use. You may use this content freely in your business operations

12. Service Availability and Support

  • We target 99.9% uptime but do not guarantee uninterrupted service
  • Planned maintenance will be communicated in advance where possible
  • If the AI provider is temporarily unavailable, core Platform features (booking, CRM, payments) remain fully functional. AI features will display a clear “temporarily unavailable” message
  • Support is provided via email and in-app messaging during UK business hours

13. Limitation of Liability

To the fullest extent permitted by law:

  • AAKIJA’s total aggregate liability under these Terms shall not exceed the amount paid by the Salon in the 12 months preceding the claim
  • AAKIJA is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data
  • AAKIJA is not liable for any losses arising from the Salon’s reliance on AI-generated recommendations
  • AAKIJA is not liable for third-party service failures (Stripe payment processing delays, SMS delivery failures, email delivery issues) beyond implementing reasonable retry mechanisms

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

14. Indemnification

You agree to indemnify and hold harmless AAKIJA, its directors, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your breach of these Terms
  • Your violation of any applicable law or regulation
  • Your use of the Platform to send unsolicited or non-compliant communications
  • Any dispute between you and your salon clients

15. Modifications to the Service

We may modify, update, or discontinue features of the Platform at any time. Material changes that affect your use will be communicated with reasonable notice. If a change materially reduces the functionality you are paying for, you may cancel your subscription without penalty.

16. Modifications to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered Owners and displayed on the Platform at least 30 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

17. Governing Law and Disputes

  • These Terms are governed by the laws of England and Wales
  • Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales
  • Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any applicable Data Processing Agreement, constitute the entire agreement between you and AAKIJA regarding the Platform.
